1. About These Terms

These Terms of Use ("Terms") govern your access to and use of the website https://biophoriaa.com/ (the "Website"), including all information, features, tools, products and services made available through the Website (collectively, the "Services").

The Website and Services are operated by TrueWhoolistic Healthcare Private Limited, trading as Biophoriaa ("Biophoriaa", "Company", "we", "us" or "our"). Shopify provides the e-commerce technology that enables us to operate the Website, but purchases made through the Website are transactions directly between you and the Company.

By accessing the Website, creating an account, placing an order or otherwise using the Services, you acknowledge that you have read and agree to be bound by these Terms and the policies incorporated into them. If you do not agree, you must not use the Website or Services.

2. Eligibility and Account Responsibility

You must be at least 18 years old, or the age of majority applicable in your jurisdiction, to place an order. A minor may use the Website only under the supervision of a parent or lawful guardian who agrees to these Terms and is responsible for the minor's use.

You agree to provide complete, accurate and current information when creating an account or placing an order. You are responsible for safeguarding your login credentials and for activity carried out through your account. Please notify us immediately if you suspect unauthorised use of your account.

We may suspend or restrict an account where we reasonably believe that the account is being used fraudulently, unlawfully or in breach of these Terms.

3. Product Information and Health Disclaimer

We take reasonable care to display product descriptions, ingredients, directions, quantities, packaging, prices and images accurately. Product colour, appearance or packaging may vary slightly from what is shown on your device, and packaging may be updated without prior notice where the product itself is not materially changed.

Biophoriaa products are health supplements and are not intended to diagnose, treat, cure or prevent any disease. Information on the Website is provided for general educational and informational purposes only and is not medical advice or a substitute for advice, diagnosis or treatment from a qualified healthcare professional.

Always read the product label and follow the stated directions and warnings. Consult a qualified healthcare professional before using a supplement if you are pregnant, nursing, under medical supervision, taking medication, have an allergy or medical condition, or are considering use by a child. Individual experiences and results may vary.

To the extent permitted by applicable law, we may update product information, correct errors, discontinue products or limit available quantities. Nothing in these Terms limits any mandatory consumer right arising from inaccurate, defective, unsafe or misdescribed goods.

4. Orders and Contract Formation

When you submit an order, you make an offer to purchase the selected product or products. An automated order acknowledgement confirms receipt of your order but does not by itself mean that the order has been accepted. A binding sale is formed when we confirm acceptance or dispatch the order, subject to applicable law.

We may decline, hold or cancel an order before dispatch where a product is unavailable, pricing or product information is materially incorrect, payment is not authorised, the delivery address is incomplete or unsupported, purchase limits are exceeded, or we reasonably suspect fraud, misuse or unlawful activity.

If we cancel a prepaid order, we will initiate a refund to the original payment method in accordance with our Return, Refund & Cancellation Policy. We may contact you using the email address or phone number submitted with your order if verification or additional information is required.

5. Prices, Taxes, Offers and Payment

Prices are displayed in Indian Rupees unless stated otherwise. The amount payable at checkout will include applicable taxes and any disclosed delivery or handling charges. Where stated on the Website or invoice, prices are inclusive of Goods and Services Tax (GST).

Promotional offers, discount codes, bundles and free gifts are subject to their stated conditions, availability and validity period. Unless expressly allowed, promotions cannot be combined, exchanged for cash or applied retrospectively. We may correct a genuine pricing or promotional error before accepting or dispatching an order.

Payments may be processed by independent payment service providers. Your use of a payment method may also be subject to the provider's terms. We do not directly store complete card or bank-account credentials unless expressly disclosed in our Privacy Policy and permitted by applicable law.

6. Shipping and Delivery

Shipping destinations, estimated processing and delivery times, tracking, delivery issues and related conditions are described in our Shipping Policy. The Shipping Policy forms part of these Terms.

Delivery dates are estimates unless we expressly agree otherwise. Delays may occur because of courier operations, weather, public restrictions, incorrect address information, force majeure events or other circumstances beyond our reasonable control. We will provide assistance in accordance with applicable law and the Shipping Policy.

You are responsible for providing a complete and accurate delivery address and an available contact number. If tracking shows an order as delivered but you have not received it, contact us promptly using the details in Section 20.

7. Returns, Replacements, Refunds and Cancellations

Eligibility, reporting windows, evidence requirements, replacement conditions, refund processing and order cancellation are governed by our Return, Refund & Cancellation Policy. That policy forms part of these Terms.

Because our products are consumable health supplements, opened, used or unsealed products may not be eligible for return or exchange except where required by applicable law or expressly allowed by the policy. Nothing in these Terms or the policy excludes remedies available for a wrong, damaged, defective, expired, unsafe or materially misdescribed product.

Where a specific policy and these Terms address the same subject, the specific policy will apply to that subject, provided that no policy may reduce rights that cannot lawfully be waived.

8. Privacy and Electronic Communications

Our collection, use, storage and sharing of personal information is described in our Privacy Policy. By using the Services, you acknowledge that you have read the Privacy Policy.

We may send transactional communications necessary to administer your account, payment, order, delivery, return or support request. Marketing communications will be sent in accordance with applicable law and your communication preferences. You may opt out of promotional messages using the unsubscribe mechanism provided or by contacting us.

9. Intellectual Property

The Website and its content, including the Biophoriaa name, logos, trademarks, product names, text, graphics, photographs, videos, designs, packaging, software and arrangement of content, are owned by or licensed to the Company and are protected by applicable intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Website for personal, lawful and non-commercial purposes. 10. Reviews and User Content

If you submit a review, image, testimonial, comment, suggestion or other content ("User Content"), you confirm that it is accurate, based on your genuine experience where applicable, lawful, and does not infringe another person's rights or disclose confidential or personal information without permission.

You retain ownership of your User Content, but grant the Company a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, reproduce, adapt, publish, display and use that User Content for operating, improving and promoting the Company and its products, subject to applicable law and our Privacy Policy.

We may moderate or remove User Content that is unlawful, misleading, abusive, defamatory, infringing, fraudulent, promotional spam or otherwise inconsistent with these Terms. We are not required to publish every submission.

11. Acceptable Use

You must not use the Website or Services to violate any law or third-party right; submit false, deceptive or fraudulent information; interfere with the Website's security or operation; introduce malware or harmful code; gain unauthorised access to systems, accounts or data; harvest personal information; send spam; impersonate another person; use automated tools to scrape or overload the Website; or resell products where resale is prohibited by us or applicable law.

We may restrict access, cancel affected orders or take other proportionate action where we reasonably believe that these restrictions have been breached.

12. Third-Party Services and Links

Third parties operate under their own terms and privacy notices. This disclaimer does not apply to any statutory guarantee, product responsibility or consumer remedy that cannot lawfully be excluded or limited.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, defective or unsafe products where liability cannot be excluded, or any other liability or consumer right that cannot lawfully be excluded or limited.

Subject to the preceding paragraph and to the fullest extent permitted by applicable law, the Company will not be liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable when the relevant contract was formed, or for loss resulting from your misuse of a product, failure to follow label directions, unauthorised account use caused by your failure to safeguard credentials, or circumstances outside our reasonable control.

Where liability may lawfully be limited, the Company's aggregate liability arising from a particular order will not exceed the amount paid by you for the product or products giving rise to the claim. This limitation does not reduce any mandatory remedy available under consumer-protection or product-liability law.

16. Indemnity

To the extent permitted by applicable law, you agree to indemnify the Company against third-party claims, losses and reasonable costs arising directly from your unlawful use of the Website, infringement of another person's rights, fraudulent conduct, or material breach of these Terms. This clause does not require a consumer to indemnify the Company for the Company's own negligence, breach of law or product responsibility.

17. Force Majeure

We will not be responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, epidemic or pandemic restrictions, war, civil disturbance, government action, power or network failure, labour disruption, transport interruption or courier disruption. We will take reasonable steps to minimise the effect and perform affected obligations when reasonably practicable. Your mandatory rights remain unaffected.

18. Governing Law and Jurisdiction

These Terms and any separate agreement through which we provide the Services are governed by and construed in accordance with the laws of India.

Before commencing formal proceedings, you and the Company should first attempt in good faith to resolve the dispute through customer support. Subject to applicable consumer-protection law and any forum or jurisdiction that cannot lawfully be excluded, the courts at Rajkot, Gujarat, India will have exclusive jurisdiction over disputes arising from or relating to these Terms, the Website or the Services.

Nothing in this section prevents an eligible consumer from approaching a competent Consumer Disputes Redressal Commission or exercising another statutory remedy available under Indian law.

19. Changes to These Terms

We may update these Terms to reflect changes in law, products, technology or business operations. The revised Terms will be posted on this page with an updated effective date. Where required by applicable law, we will provide additional notice. Changes will not retrospectively reduce rights arising from an order accepted before the change.

You may also use our Contact Us page. Please include your order number and sufficient details to help us investigate. We aim to acknowledge consumer complaints within 48 hours and resolve them within one month from receipt, subject to applicable law and the nature of the complaint.

21. General Provisions

If any provision of these Terms is held unlawful or unenforceable, it will be modified or severed only to the minimum extent necessary, and the remaining provisions will continue in effect.

A failure or delay by the Company in enforcing a right does not waive that right. You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer our rights or obligations as part of a merger, restructuring, sale of business or other lawful transaction, provided that your mandatory consumer rights are not reduced.

These Terms, together with the Privacy Policy, Shipping Policy, Return, Refund & Cancellation Policy and any product- or promotion-specific conditions expressly presented to you, constitute the agreement between you and the Company concerning the Website and Services.
